Terms for using Evidiam.
1. The service
Evidiam provides software for sponsor-bank and fintech compliance evidence workflows, including intake, evidence mapping, data ingestion, human approvals, packet generation, review, verification, and related trust records.
2. Accounts and access
You are responsible for authorized account use, keeping credentials secure, and promptly notifying Evidiam of suspected unauthorized access. You may not share accounts or bypass authentication, authorization, rate limits, or security controls.
3. Customer data and permissions
Customers retain ownership of documents, records, evidence, and other data submitted to Evidiam. Customers represent that they have the rights and permissions needed to provide that data to Evidiam and to authorize Evidiam to process it to provide the service.
Evidiam may use aggregated or de-identified information to understand service performance and improve product quality, provided it does not identify a customer or individual.
4. Compliance responsibility
Evidiam is software. It is not a bank, law firm, compliance consultant, auditor, or regulator. Evidiam does not provide legal, regulatory, banking, accounting, or audit advice.
Customers are responsible for their own compliance programs, filings, bank relationships, regulatory decisions, and approval outcomes. Evidiam does not guarantee that a sponsor bank, regulator, auditor, investor, or counterparty will accept any packet or evidence record.
5. AI-assisted features
Evidiam may use AI-assisted features to draft summaries, extract obligations, classify records, or prepare rationale. AI output is draft support only. Customers must review and approve material judgments before relying on them.
6. Acceptable use
You may not use Evidiam to violate law, infringe rights, upload malicious code, interfere with the service, attempt unauthorized access, reverse engineer the service except where legally permitted, or submit data you are not authorized to process.
7. Confidentiality and security
Each party will protect non-public information received from the other party with reasonable care and use it only for the business relationship. Evidiam maintains a security posture described on the Security page, but no service can be guaranteed error-free or perfectly secure.
8. Third-party services
Evidiam relies on third-party services for hosting, authentication, storage, email, and optional AI processing. Current subprocessors are listed on the subprocessors page.
9. Fees, pilots, and suspension
Fees, pilot terms, and usage limits are governed by the applicable order form or written agreement. Evidiam may suspend access to protect the service, prevent harm, address non-payment, or comply with law.
10. Disclaimers and limits
Except as expressly stated in a signed agreement, the service is provided as is and as available. To the maximum extent permitted by law, Evidiam disclaims implied warranties and will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages.
